Acceptance of Terms

By creating an account or using our services, you confirm that you:

• Have the legal capacity to enter into these Terms
• Will comply with all applicable laws and regulations

Description of Services

Fusmake provides AI-powered video generation services, including:

• Text-to-video generation using AI models (Sora 2, Veo 3, etc.)
• Image-to-video animation
• Video storage and download capabilities
• Credit-based usage system

User Accounts

Account Creation

• You must provide accurate and complete information when registering
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access

Account Responsibilities

• You are responsible for all activities under your account
• You may not share your account with others
• You may not create multiple accounts to abuse free credits or promotions

Credits and Payments

Credit System

• Video generation requires credits
• Credits are consumed based on the AI model used and video parameters
• Unused credits may expire according to your plan terms

Payments

• All payments are processed securely through Stripe
• Subscription fees are billed in advance
• Refunds are handled according to our refund policy

Refund Policy

• Unused credits from credit packages are non-refundable
• Subscription cancellations take effect at the end of the billing period
• We may offer refunds at our discretion for service issues
• Content Moderation Failures: If your generation fails due to content policy violations or provider risk controls, your credits will be automatically refunded. We employ automated content filtering, but some requests may be flagged by our AI providers' safety systems after submission.

Content and Intellectual Property

Your Content

• You retain ownership of text prompts and images you upload
• You grant us a license to process your content for service delivery
• You are responsible for ensuring you have rights to uploaded content

AI-Generated Content

• You receive a license to use AI-generated videos for personal and commercial purposes
• This license is subject to the terms of the underlying AI model providers
• You may not claim AI-generated content infringes on others' rights

Prohibited Content

You may not use Fusmake to generate:

• Illegal content or content promoting illegal activities
• Content depicting minors in inappropriate situations
• Non-consensual intimate imagery or deepfakes of real people
• Content that infringes on intellectual property rights
• Hate speech, harassment, or content promoting violence
• Spam, malware, or deceptive content

Acceptable Use

You agree not to:

• Reverse engineer or attempt to extract our AI models
• Use automated systems to abuse our services
• Circumvent usage limits or security measures
• Resell or redistribute our services without authorization
• Use our services to compete directly with Fusmake

Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service
• We may modify, suspend, or discontinue features with reasonable notice
• Scheduled maintenance will be announced in advance when possible

Limitation of Liability

To the maximum extent permitted by law:

• Fusmake is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months

Indemnification

You agree to indemnify and hold Fusmake harmless from claims arising from:

• Your use of our services
• Content you create or upload
• Your violation of these Terms
• Your violation of any third-party rights

Termination

By You

• You may close your account at any time through account settings
• Closing your account does not entitle you to refunds for unused credits

By Us

• We may suspend or terminate accounts that violate these Terms
• We may terminate accounts for prolonged inactivity
• We will provide notice when reasonably possible

Changes to Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance. We will notify you of material changes via email or platform notification.

Governing Law

These Terms are governed by the laws of the jurisdiction where Fusmake operates, without regard to conflict of law principles.

Dispute Resolution

Any disputes will be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.
